Welcome to Dukana. These Terms and Conditions ("Terms") govern your access to and use of the Dukana mobile application and related services (collectively, the "Service"), operated by Dukana ("we," "us," or "our"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By downloading, installing, or using the Dukana application, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use our Service.

If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" will refer to that entity.

You must be at least 18 years of age to use our Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old.

2. User Accounts

To access most features of Dukana, you must create an account. When you register, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and not share them with third parties.
  • Notify us immediately at [email protected] if you suspect unauthorized access to your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe have been created fraudulently or are being used in violation of these Terms.

Workspace and Store

When you create a workspace (store) in Dukana, you become the Owner of that workspace. As Owner, you may invite team members and assign roles (Assistant, Seller, or custom roles). You are responsible for all activity within your workspace, including actions taken by team members you invite.

3. Subscription Plans

Dukana offers the following plans:

  • Free Plan: Access to core features at no cost, subject to the usage limits described in the app.
  • Pro Plan: Enhanced features including advanced analytics, reports, and team management, billed monthly or annually.
  • Ultimate Plan: Full-featured access including unlimited team members, custom roles, and priority support, billed monthly or annually.

Billing and Payment

Paid plans are billed in advance on a recurring basis (monthly or annual) via the applicable app store (Apple App Store or Google Play Store). By subscribing to a paid plan, you authorize the app store to charge your payment method on file.

All fees are non-refundable except as required by applicable law or as otherwise expressly stated. If you cancel a paid subscription, your access to paid features will continue until the end of the current billing period.

Plan Changes and Cancellation

  • You may upgrade or downgrade your plan at any time within the app or through the applicable app store settings.
  • Cancellation of a paid subscription must be done through the app store. We cannot process cancellations directly.
  • We reserve the right to modify pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

Free Trial

We may offer free trials of paid plans from time to time. Unless you cancel before the trial period ends, your payment method will be automatically charged at the applicable subscription rate.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal activity or in violation of any applicable local, national, or international laws.
  • Attempt to gain unauthorized access to any part of the Service, other user accounts, or any related systems.
  • Introduce any malware, viruses, or other harmful code into the Service.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Scrape, crawl, or otherwise extract data from the Service in an automated manner without prior written consent.
  • Misrepresent your identity or affiliation with any person or entity.
  • Use the Service to send unsolicited communications (spam) to your customers or team members.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to store, transmit, or process data in a manner that violates applicable data protection laws.

Violation of these restrictions may result in immediate termination of your account without notice or refund.

5. Your Data

You retain ownership of all data you input into Dukana, including product catalogs, sales records, customer information, and business data ("Your Data").

By using the Service, you grant us a limited, non-exclusive, worldwide license to process Your Data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

We do not sell Your Data to third parties. For details on how we handle your personal information, please review our Privacy Policy.

Data Accuracy

You are solely responsible for the accuracy and completeness of the data you enter into Dukana. We are not responsible for business decisions you make based on data you have entered.

Data Portability

Upon request, we will provide you with an export of Your Data in a common machine-readable format within a reasonable timeframe. For data export requests, contact us at [email protected].

6. Intellectual Property

The Dukana application, including its design, features, text, graphics, software, and underlying technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Dukana app solely for your internal business purposes.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on any part of the Service without our prior written permission.

7. Third-Party Services

The Service may integrate with or link to third-party services, including but not limited to:

  • Firebase (Google): Authentication and push notifications.
  • Apple App Store / Google Play Store: App distribution and in-app purchases.
  • RevenueCat: Subscription management and billing.

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or reliability of any third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • Any defects in the Service will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DUKANA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

10. Termination

You may terminate your account at any time by deleting the app and cancelling your subscription through the applicable app store. Account deletion requests can also be submitted within the app under Account Settings.

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if:

  • You breach any provision of these Terms.
  • We are required to do so by law or a valid court order.
  • We reasonably believe your account is being used for fraudulent or illegal purposes.
  • We decide to discontinue the Service (with reasonable advance notice where possible).

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

  • Updating the "Last updated" date at the top of this page.
  • Sending a push notification or in-app message for significant changes.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dukana operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
